Who owns the data a franchisee generates?
Almost always the franchisor, under the franchise agreement. Most agreements grant the franchisor broad rights to unit-level operating data — terms written before AI made that data valuable for training models.

The standard position
Franchise agreements typically assign the franchisor ownership or a broad licence over transaction, customer and operating data generated at the unit. This predates AI and was not controversial when the data only produced reports.
What changed
That same data now trains models that become a system-wide asset. A franchisee supplies an input to something of significant value and generally holds no claim on it.
The clause has not changed. What the clause is worth has changed enormously, and it changed without renegotiation.
What to check before signing

—Whether data may be used to train models, and whether that is stated at all.
—What happens to the data on transfer or termination.
The honest caveat
